Terms of Service

CigarHub ("CigarHub", "we", "us") operates a social network and marketplace for the cigar community (the "Platform"). By creating an account, accessing the Platform, or using any of its features, you agree to these Terms of Service and to our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the Platform.

You must have the legal capacity to enter into this agreement. If you use the Platform on behalf of a business, you represent that you are authorised to bind that business, and "you" refers to both you and that business.

The Platform is restricted to adults aged 21 years or older. It concerns tobacco products and is not directed to, and may not be used by, anyone under the age of 21. There is no exception to this requirement.

• Self-attestation at signup. Your age is self-attested when you register: you must provide your date of birth and affirmatively confirm that you are 21 or older. Account creation is blocked unless you do so, and we refuse registration where the date of birth given indicates an age under 21.
• Truthful information required. Providing a false date of birth or a false age confirmation is a material breach of these Terms and will result in termination of your account.
• No sale or advertising to minors. No tobacco product may be sold, offered, promoted, advertised, sampled or otherwise made available to any person under the age of 21 through the Platform, by us or by any user, vendor or advertiser.
• Additional verification. Community and marketplace features sit behind further age verification. We may require additional proof of age at any time and may suspend access until it is provided.
• Local law. Where the minimum legal age for tobacco in your jurisdiction is higher than 21, that higher age applies to you. You are responsible for complying with all laws that apply where you live.

If we learn that an account belongs to someone under 21, we will terminate it and delete the associated personal data. To report an underage account, contact contact@cigarhub.cloud.

CigarHub operates a zero-tolerance policy on racism, hate speech and racial discrimination. This applies to every part of the Platform without exception — posts, comments, messages, profiles, storefronts, product listings, event listings, live audio and video rooms, and all advertising or promotional material.

Prohibited content and conduct includes, without limitation:

• Racist content, racial slurs, or content that demeans, dehumanises or stereotypes a person or group on the basis of race, colour, ethnicity or national origin.
• Hate speech or content that attacks, threatens, harasses or incites violence or hatred against a person or group on the basis of race, colour, ethnicity, national origin, religion, sex, gender, gender identity, sexual orientation, disability or any other protected characteristic.
• Discrimination against any person or group on any of those grounds, including refusing service, access or opportunity through the Platform on those grounds.
• Promoting, endorsing or affiliating with organisations that engage in the above, or displaying their symbols or imagery.

Consequence: immediate and permanent termination, without appeal. An account found to have engaged in any of the above will be terminated immediately and permanently. This decision is final and is not subject to appeal or reinstatement. We may also remove all associated content, cancel any storefront or advertising, and permanently bar the individual and the business from creating any future account. Where conduct may be unlawful, we may report it to law enforcement.

No refund of any subscription, advertising or listing fee is due on a termination under this section.

This section is the CigarHub Advertising Policy. It applies to every advertisement, sponsorship, sponsored placement, storefront promotion and other paid or promotional material on the Platform, and it binds every advertiser and vendor.

• All advertising is age-gated to 21+. Ads are served only to accounts that have attested to and, where required, verified an age of 21 or over. Advertising may never be directed to, or designed to appeal to, minors.
• Every ad carries an #ad disclosure. All advertising and sponsored content must be clearly and conspicuously identified as such. The Platform applies a "Sponsored" label and an #ad disclosure to paid placements, and advertisers must not remove, obscure or undermine that disclosure.
• AI-generated content must be labelled. Any advertisement, image, video or copy that is generated or materially altered by artificial intelligence must be labelled as AI-generated in accordance with platform rules and applicable law.
• No targeting by race, religion or gender. Advertisements and audiences may not be targeted, segmented, included or excluded on the basis of race, ethnicity, religion or gender. Targeting tools on the Platform do not offer these categories, and attempting to achieve such targeting by proxy is prohibited.
• No appeal to minors. Advertising must not use cartoons, characters, imagery, themes, music, influencers or placements that appeal to people under 21, and must not depict or feature anyone under 21.
• No unfounded claims. Advertising must not make health, wellness, therapeutic, safety or financial claims about tobacco products, and must not present tobacco use as reduced-risk, healthy or necessary for social, professional or sexual success.
• Lawful, accurate and reviewed. Advertisers are responsible for complying with all tobacco advertising, marketing and consumer protection laws that apply to them, including any required health warnings. All ads are subject to review before and after publication, and we may reject, pause or remove any ad at our discretion.
• Prohibited advertising. No advertising of illegal products, counterfeit goods, weapons, illegal drugs, or content that violates Section 3.

Breach of this Advertising Policy may result in removal of the advertising, forfeiture of fees paid, suspension of advertising privileges and termination of the account. Breaches that fall under Section 3 result in immediate and permanent termination without appeal.

You must provide accurate, current and complete information when registering and keep it up to date. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us promptly at contact@cigarhub.cloud if you believe your account has been compromised.

One person may hold one personal account. You may not share, sell or transfer your account, and you may not create a new account to evade a suspension or termination.

In addition to Sections 3 and 4, you agree not to:

• Post content that is unlawful, harassing, defamatory, sexually explicit, violent, or that exploits or endangers any person.
• Sell, offer or facilitate the sale of illegal goods, counterfeit products, weapons or illegal drugs.
• Misrepresent your identity, your business, your products or your affiliation with any brand.
• Infringe anyone's intellectual property or privacy rights.
• Interfere with, scrape, overload, reverse engineer or attempt to gain unauthorised access to the Platform or another user's account.
• Use the Platform to send spam or bot-generated activity, or to manipulate metrics, ratings or reviews.

We may remove content and suspend or terminate accounts that breach these Terms. We are not obliged to monitor content, but we may review, moderate and remove it at our discretion.

Verified brands, lounges and retailers may operate storefronts and list products. If you operate a storefront, you are solely responsible for your listings, prices, stock, fulfilment, customer service, taxes, licences and compliance with every law that applies to the sale and shipment of tobacco products — including age verification at the point of sale and delivery.

CigarHub provides the venue and the tools. Unless expressly stated otherwise, CigarHub is not the seller of, and is not a party to any transaction for, products listed by vendors, and does not guarantee any listing, vendor or product. Subscription, listing and advertising fees are described at the point of purchase and are payable through our payments provider.

You retain ownership of the content you post. By posting, you grant CigarHub a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt for formatting and distribute that content for the purpose of operating and promoting the Platform. You represent that you have the rights necessary to grant this licence.

The CigarHub name, logo, design and software are owned by CigarHub and may not be used without our prior written permission.

You may stop using the Platform and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if we are required to by law, or if we reasonably believe your conduct creates risk or legal exposure for CigarHub or other members. Terminations under Section 3 are immediate, permanent and not subject to appeal.

Sections that by their nature should survive termination — including Sections 3, 8, 10 and 11 — will survive.

The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted, secure or error-free, or that any content or vendor listing is accurate or complete.

Nothing on the Platform is medical, legal or financial advice. Tobacco products carry serious health risks. To the fullest extent permitted by law, CigarHub will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of your use of the Platform.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where the change is material, provide additional notice. Continued use of the Platform after a change takes effect means you accept the updated Terms.
